Article 1 Introduction

This Privacy Policy is of “App To Go B.V.,a limited liability company incorporated under Dutch law, with its registered office at Johannes Verhulststraat 136 H (1071 NN) Amsterdam, and registered with the Chamber of Commerce under number 93181043 (hereinafter also referred to as "we", "us", or "our"). This Privacy Policy is part of the Terms of Use and applies when you use or have a registered account on the Platform MissedYou. By using the Platform MissedYou you accept the terms and conditions of this policy. If you have any questions and/or comments about this, you can contact the contact details below.

All terms used in this Privacy Policy that are defined in the Terms of Use shall have the same meaning as in the Terms of Use unless otherwise defined in this Privacy Policy. If any term is not defined in this Privacy Policy, it shall be interpreted in accordance with the definitions provided in the Terms of Use.

Article 2 Who is responsible for the processing of your personal data?

App To Go B.V. is the ‘Data Controller’ with the meaning of article 4 (7) GDPR and is responsible for

the collection and processing of your personal data that you need to provide in order to use the Platform MissedYou.

2.1 Personal Information:

The following personal information will be collected and used in order to use the Platform MissedYou to communicate (chat/mail/ call) with another and share your (personal) interests:

  • Name
  • Email address
  • Residence
  • Gender
  • Age
  • Data of birth
  • Photo (optional)
  • The personal information you share with other User(s). Think carefully before sharing (sensitive) information with us!  We will only use the (generic) information according to the purposes and principles described in this Privacy Policy and will no longer make it traceable to a user but will be anonymized and only used to improve the Platform MissedYou.

2.2 Combined Information: 

We may combine the information collected through our Platform MissedYou with other personal data we have about you, as described in this Privacy Policy. Any combined information will be treated as personal information.

2.3 Usage information: 

We collect details about your interactions with the Platform MissedYou, including non-identifying usage information. If we associate this data with you as a specific, identifiable person, we treat it carefully as personal information. We may collect data related to your usage patterns, device information, IP address, and the date and time of your interactions to optimize platform MissedYou performance and security.

(1) allow you to participate in the Platform MissedYou, including responding to your questions, complaints, or comments (to other users individually or in a group);

(4) improve our Platform MissedYou and the related services, including enhancing our AI chat algorithms;

2.5 Legal grounds

The processing of your personal data is based on the following legal grounds within the meaning of article 6 GDPR:

a) The execution of an agreement to which you as a User you are a party, in the context of which you gain access to the MissedYou platform after you have created an account.

b) The legitimate interest in providing, improving, developing and optimizing the Platform MissedYou and related services. In doing so, a careful consideration has been made in advance and of your privacy against the interests of the Platform MissedYou. We conclude that your interest in this matter does not outweigh our interest, also in view of the technical and organizational security measures we have taken.

(c) We may also process your personal data based on our legitimate interest, such as for marketing, statistical and tax purposes. We want to continuously improve our Platform MissedYou, features, and content and allow users to navigate the Platform MissedYou with ease. We use this technical data to analyze the use of the Platform MissedYou and to increase its functionality and ease of use, as well as to better tailor it to the needs of our users. Therefore, we can:

  • Send marketing messages via email or chat services to those who have registered or subscribed to our newsletter. For example, marketing messages may include information about our Platform, service updates, (promotional) events as well as other news. You can opt out of receiving marketing messages and unsubscribe from our mailing list at any time.
  • Customize, measure, and improve the Platform MissedYou, content, and advertising. We may send offers based on your preferences.
  • Using cookies (Cookie Policy) or other similar techniques for statistical purposes, to generate anonymous summary statistics that allow us to understand how our users use the Platform MissedYou and to increase its user-friendliness.

(d) We may process your personal information if required to comply with legal obligations, protect our rights, or respond to legal processes.

(e) Please note if we have not one of the legal ground as aforementiond  (a untill d) to process your personal data we will ask your prior consent to process your data.

Article 3 Data storage and retention

We store your data within Europe. However, it may happen that certain data we collect is transferred to or stored at a location outside of Europe, via our external service providers, such as Google. In such cases, we will ensure that this is done in a secure and lawful manner and take appropriate measures to ensure that your data is protected as best as possible."

We store your personal data only for as long as necessary to be able to use and provide our services related to the Platform MissedYou. After that, we will delete or anonymize your personal data, except when the law or the rights or obligations of either party require a longer retention period.

Article 4  Data Protection and Security

We employ industry-standard security measures to protect your personal and research data from unauthorized access, disclosure, or alteration. We take data security seriously and enforce commercially reasonable technical, physical, and administrative measures to safeguard personal information during transmission and once it is received.

Article 5 Information Sharing Third Parties

We do not share your personal information with third parties for marketing purposes. However, we may share aggregated and anonymized data for research and statistical analysis (as mentioned above).

Article  6  Engaged partners sharing 

We may share your information with: 

- Business partners, vendors, suppliers, and subcontractors who provide services on our behalf. These entities may only use your personal information as necessary to provide their services. 

- Analytics providers (e.g., Google Ads and analytics) and search engine operators to improve and optimize our website. 

- Payment processors to fulfill transactions.

We ensure that these parties offer sufficient guarantees with regard to the technical and organisational security measures and enter into a data processing agreement with them.

Our Platform MissedYou may include links to and from Third-Party websites such as Facebook and Instagram. If you follow any of these links, please note that these websites have their own privacy policies, and we do not accept responsibility or liability for their content. Review their policies before submitting personal information.

Article 8 Your Privacy Rights

You (as User) have the right to access personal data that we hold about you. If you believe that the personal data, we hold is inaccurate or incomplete, you have the following rights concerning your personal information:

a. Right to access;

c. Right to erasure; 

d. Right to restrict processing; 

e. Right to object to processing; 

f. Right to withdraw consent.

Article 9 Changes to Privacy Policy

We reserve the right to update this Privacy Policy periodically. Users will be notified of significant changes through the platform or other communication channels.
